The Truth About the Health Care Bills

Well, I have done it! I have read the entire text of proposed House Bill 3200: The Affordable Health Care Choices Act of 2009. I studied it with particular emphasis from my area of expertise, constitutional law. I was frankly concerned that parts of the proposed law that were being discussed might be unconstitutional. What I found was far worse than what I had heard or expected.

To begin with, much of what has been said about the law and its implications is in fact true, despite what the Democrats and the media are saying. The law does provide for rationing of health care, particularly where senior citizens and other classes of citizens are involved, free health care for illegal immigrants, free abortion services, and probably forced participation in abortions by members of the medical profession.

The Bill will also eventually force private insurance companies out of business, and put everyone into a government run system. All decisions about personal health care will ultimately be made by federal bureaucrats, and most of them will not be health care professionals. Hospital admissions, payments to physicians, and allocations of necessary medical devices will be strictly controlled by the government.

However, as scary as all of that is, it just scratches the surface. In fact, I have concluded that this legislation really has no intention of providing affordable health care choices. Instead it is a convenient cover for the most massive transfer of power to the Executive Branch of government that has ever occurred, or even been contemplated If this law or a similar one is adopted, major portions of the Constitution of the United States will effectively have been destroyed.

The first thing to go will be the masterfully crafted balance of power between the Executive, Legislative, and Judicial branches of the U.S. Government. The Congress will be transferring to the Obama Administration authority in a number of different areas over the lives of the American people, and the businesses they own. The irony is that the Congress doesn’t have any authority to legislate in most of those areas to begin with! I defy anyone to read the text of the U.S. Constitution and find any authority granted to the members of Congress to regulate health care.

This legislation also provides for access, by the appointees of the Obama administration, of all of your personal healthcare direct violation of the specific provisions of the 4th Amendment to the Constitution information, your personal financial information, and the information of your employer, physician, and hospital. All of this is a protection against unreasonable searches and seizures. You can also forget about the right to privacy. That will have been legislated into oblivion regardless of what the 3rd and 4th Amendments may provide…

If you decide not to have healthcare insurance, or if you have private insurance that is not deemed acceptable to the Health Choices Administrator appointed by Obama, there will be a tax imposed on you. It is called a tax instead of a fine because of the intent to avoid application of the due process clause of the 5th Amendment. However, that doesn’t work because since there is nothing in the law that allows you to contest or appeal the imposition of the tax, it is definitely depriving someone of property without the due process of law.

So, there are three of those pesky amendments that the far left hate so much, out the original ten in the Bill of Rights, that are effectively nullified by this law. It doesn’t stop there though.

The 9th Amendment that provides: The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people; The 10th Amendment states: The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are preserved to the States respectively, or to the people. Under the provisions of this piece of Congressional handiwork neither the people nor the states are going to have any rights or powers at all in many areas that once were theirs to control.

I could write many more pages about this legislation, but I think you get the idea. This is not about health care; it is about seizing power and limiting rights…

Article 6 of the Constitution requires the members of both houses of Congress to “be bound by oath or affirmation to support the Constitution.” If I was a member of Congress I would not be able to vote for this legislation or anything like it, without feeling I was violating that sacred oath or affirmation. If I voted for it anyway, I would hope the American people would hold me accountable. For those who might doubt the nature of this threat, I suggest they consult the source, the US Constitution, and Bill of Rights. There you can see exactly what we are about to have taken from us.

EDUCATION- A SUMMARIZATION

 

For the past several weeks I have written and posted numerous articles on https://cb75948.wordpress.com . All of the articles on education in Texas have been printed in the Sabine County Reporter thanks to Stephanie Corley.

The surprises I have discovered from factual sources have been unbelievable. Unfortunately less than one percent of the source information has been found in the main stream media. Mountains of information are available on the internet and I wonder how much is read by the general public? Based on the feedback I have received, most people other than teachers; really do not care about children’s education. I suppose that parents today are too involved with other matters and expect teachers to formulate both education and discipline for their children.

For those of you who live in a state with unionized teachers and administrators, you have let the politicians destroy public education. Unions and liberal elected politicians have sold their soul at the expense of your children. It is sad to read about the waste of adequate education to feather the bed of supposed professional educators with retirement benefits that are outlandish at best. Teachers who are paid in excess of $100,000.00 a year to do nothing, because they can’t be terminated because of tenure, is stupid. Creation of Fraudulent insurance arrangements that line the pockets of the unionized teachers is shameful.

In Texas we do not suffer with unionized teachers, yet. Unfortunately a teacher must align with a teachers group if they desire to purchase liability insurance. In Texas our politicians have let the university level educators create so many shadow groups aligned with or part of the Texas Education Agency (TEA); K-12 education is being destroyed. Sadly these tenured professors and money hungry administrators have our Governor and legislators mesmerized with trying to make every student a rocket scientist, doctor, and God forbid a lawyer.

Spending time with administrators in our local K-12 district has awakened me to the fact that we have major problems in the future. Professionals at this level have not even been contacted regarding the impact of additional credits now required to graduate from high school. The majority of these children will never attend a college or university. The peer pressure of lower grade diplomas will create an increase in drop outs of academically limited students. I have not read one article in the media that has addressed this obvious train wreck. Texas politicians will never understand what they have allowed to happen if it ran over them in the parking lot.

Texas allocation of funds to local school districts is a mockery of common sense. Politicians created the mess when they screwed up the property tax system. Rather than admitting they blew it, they spent millions developing a system no one understands called WADA. This added more costs to the small school districts that I have already posted. The new STAAR testing program, that I previously reported will go down in flames but we will have wasted a billion dollars. By then the State Senators who allowed this to happen will be retired and care less. It would be nice to know if any of our legislators own stock in the testing contractor.

As the Texas legislature has yet to finalize the massive budget reductions for education, it is impossible to evaluate the impact locally for the children. I will continue to monitor the situations and report my findings.

-New Word For The Day – “Dhimmitude” – What Does It  Mean?

Obama used it in the  health care bill.

Now isn’t this interesting? It was used in the health care law.

Every day there’s another revelation of what Obama and his fellow  Democrats are doing to our country.

Dhimmitude —  I had never heard the word until now. Type it into Google and start  reading. Pretty interesting. It’s on page 107 of the healthcare  bill. I looked this up on Google and yep, it exists. It is a REAL  word.

Word  of the Day: Dhimmitude  is the Muslim  system of controlling non-muslim populations conquered through  jihad. Specifically, it is the TAXING of non-muslims in exchange for  tolerating their presence AND as a coercive means of converting  conquered remnants to Islam.

Obama  Care allows the establishment of Dhimmitude and Sharia Muslim diktat  in the United States . Folks, this is exclusively an Islamic concept  under Sharia Law. So exclusive they had to make up an English word  to define the concept. Why would our government start interjecting  Sharia Law concepts into new broad and sweeping legislation like  health care that would control the US population?  ….Anyone?

Muslims are  specifically exempted from the government mandate to purchase  insurance, and also from the penalty tax for being uninsured. Islam  considers insurance to be “gambling”, “risk-taking”, and “usury” and  is thus banned. Muslims are specifically granted exemption based on  this.

How  convenient. So a Christian, will have crippling IRS liens placed  against all of their assets, including real estate, cattle, and even  accounts receivables, and will face hard prison time because they  refuse to buy insurance or pay the penalty tax. Meanwhile, Louis  Farrakhan and all other US Muslims will have no such penalty and  will have 100% of their health needs paid for by the de facto  government insurance. Non-Muslims paying a tax to subsidize  Muslims. This is Sharia Law definition of…  Dhimmitude. This is not a Western Civilization concept.

Dhimmit has two purposes: To enrich Muslims AND to drive conversions  to Islam. “Sure, I’ll be a muslim if it means free health insurance  and no taxes. Where do I sign, bro?”

I  recommend sending this post to your contacts. This is desperately  important and people need to know about it — quickly!

WISCONSIN-HAS MADE ALL TEACHERS FUTURE ENDANGERED

 

Every teacher in America can thank the Milwaukee school district greed for driving the nail in the coffin for most teachers nationwide. The slaughter of good teachers is well underway here in Texas. Wisconsin should not get all of the credit as California, Michigan, Iowa, Indiana, New York, Illinois and others were just as guilty of sticking it to the taxpayer. Unfortunately Milwaukee greed in particular, got in the crosshairs between a new Governor and democratic legislature that captured the headlines and put a well deserved bulls-eye on the teachers and the unions. What has happened in Wisconsin will reshape the future for every school district in America. Fortunately many do actually deserve to be penalized; sadly the ones who have been managed professionally will suffer more.

I like to refer to this as the “Learning Curve Law of Survival”. This law was invented by some government bureaucrat a long time ago. In 1954 I entered management at the ripe old age of 24. To survive working on government contracts I quickly learned that when the government has to reduce costs it never included common sense. The slashing will be an across the board percentage removed from your budget. If you managed your function frugally, you will suffer more than the ones who padded the books. What you make sure of before the next budget axe falls is to prostitute yourself with some cushion. Our U.S. government invented this “Law” and they practice it at every level with precise perfection.

When the smoke clears after the ensuing blood bath to end the union’s destruction of education, the ones who have unionized will suffer as they should. Unfortunately the ones who have been honest will suffer beyond reason.

Let me share some “Facts” from the Milwaukee schools. The average public school employee receives 74.2 cents in benefits for each $1 of their base pay. This is three times the benefits of the average private sector worker. The same ratio probably exists for most teachers in states that have right-to-work systems.

In Wisconsin educators also participate in Social Security. This is not true in all states. In Wisconsin there is also a state pension plan that requires 6.8% of wages being provided by the employer and 6.2% by the employee. Except in Milwaukee the public pays the teachers share also. Milwaukee teachers also enjoy another supplemental pension which the district pays 4.2% of their salaries and the teacher pays zilch. The district also pays 100% of the costs for medical and vision benefits and over 50% of cost for dental insurance. If you forgot my earlier posting, the teachers union in Wisconsin owns the insurance company with near iron clad guarantee of renewal. One other “Milwaukee Perk” is the taxpayer pays 100% for retired public employees.

As I posted earlier there are 98,000 members of the National Education Association (NEA) in Wisconsin. The NEA has 3.2 million members to fund its operations. They have 31 employees that earn over $200,000.00 a year. Dennis Van Roekel, NEA president, receives $397,721in salary and benefits. Guess who gets 98% of the NEA political donations? They currently have $216,000,000.00 in assets.

Unfortunately for the teachers in Texas, the legislature is in process of a budget crisis faced in all but four states. Preliminary information is that they are going to slash education funding over 20% next year. They are not as dumb as a rock as many would believe. They know that the brouhaha in Wisconsin about giving teachers outlandish benefits will provide them with media support and excuses for letting education take the brunt of budget cuts. I am currently in the process of gathering facts for Texas budget cuts. I plan to challenge the legislative wisdom of practicing the “The Learning Curve Law of Survival” if they actually pass any across the board cuts.

The really sad situation, for the entire United States, will be that the real loser will be the children. For some reason they have been omitted from all the media and political attention.

EDUCATION DECLINES-COSTS GO UP, WHY?

 

 

There are major reasons why education today is tragically different from in the 1930’s and 1940’s when I was educated. One reason we have had a major decline in education in America is the parents. Mothers did not work and were there daily to teach you respect for others and monitor your every activity including discipline. Dads were available to teach you about work and prepare you for life. If you challenged your mother, dad would make sure you understood that mom was always right. I learned as much from my parents as I did in school. If I had problems in school or homework, they were always there to help me.

Teachers actually taught classes without any disruption as discipline was expected and enforced. Rule #1, with any disruption you would get embarrassed verbally by the teacher. Rule #2, if you disrupted the class the second time you were likely disciplined physically by the teacher. Rule #3, next you were escorted to the principal’s office for a guaranteed physical event to get your undivided attention. Rule #3 also included notifying your parents which would probably result in some form of a Rule #4, physical punishment. As I have never been one to enjoy pain of any description, I never faced Rules 2, 3, or 4.

Bad or poor grades were another event that would result in discipline. Being berated verbally and embarrassed in class by the teacher was common practice. Showing a bad report card to my mother resulted in the loss of something important was guaranteed.

 I challenge anyone to produce any facts that parents and discipline are not the primary reasons we have lost our position of leadership in education to second and third world rated countries today.

Why has this happened?  People now want more materialistic things before they can truly afford them. Case in point, I never owned a car until I was 23 years old, had served over four years in the U.S. Navy, and was married with two children. It took that long to amass enough assets to use as collateral to borrow the $100 to purchase a 1940 car in 1953. Today it is considered punishment if you do not get a car when you turn 16. The result today is both parents have to work to provide the funds to keep up with their peers. Larger homes, fancier cars, club memberships and designer apparel are necessities rather than dreams. This success caused resentment from those without the desire to work that hard.  

Another reason is society has digressed and accepted new moral standards. One parent families only existed when I was growing up as a result of a tragedy.  Today one parent families is as commonplace as the sun rising. The number of one parent families has skyrocketed out of sight. Children do not have the preparation or support necessary to understand the need for education, work and discipline. The same resentment from these children for lack of materialistic parity has created the increase in criminal activity and instead of getting educated they occupy the prisons.

The last reason is that teachers and administrators are no longer allowed to discipline a student. If they embarrass or berate a student today it will usually result in facing a raging parent. Even if they agree with the action, they are mad because they have to interrupt their work to get involved. If physical punishment was involved you can expect the parent, their attorney and litigation. Whether you know it or not, teachers today have to buy liability insurance to protect their family assets. Today parents fear litigation for any form of physical punishment of their own children. It would not surprise me to see parents having to buy liability insurance to protect them from their own children. Obamacare has recently mandated that your children are you’re your responsibility until they are 26. This illustration is just to remind you that we did not have as many lawyers when I was young. We had no television so there were no commercials every 15 minutes from lawyers begging you to sue anybody for anything possible.

If you doubt my wisdom, please take the time to go spend just one day with a teacher in a classroom that does not include your child. If every elected politician and judge at every level of government from Obama to your local level would observe, by video, a full day of a classroom, common sense change would happen.

Again I would appreciate “factual” data that refutes my claims from anyone, including a government agency and especially the U.S. Department of Education (DOE). If the DOE would just spend 10% of the billions addressing discipline and correcting the problem, it would help the teachers and administrators immensely.

UNION DISASTERS

 

 Before the Wisconsin debacle that has dominated the recent news, my interest and knowledge about “Unions” was limited to the private business sector. I am fully aware that “Unions” have created the loss of manufacturing jobs that plague the country and why we have to import most of the consumer product we buy today. When you couple “Union” pressured trade barriers with the regulatory pressure of the “Tree huggers”, we have made conducting business in America nearly impossible. I have created businesses in Canada and the United States and without a doubt the Canadian government is far more business friendly. They actually help you get started and survive.

The “Wisconsin Disaster” unveiled another “Union” situation that has been off the radar since Reagan fired the air traffic controllers a long time ago. Unionization of government employees is one of the dumbest things I have seen evolve in my 80 years as an American. Can you just imagine that as this practice expands, we could see the “Unionization” of Congress, the Judicial and Executive branches of American government?

 We have some union type demands already in place like the lifetime terms for Federal Judges and the Supreme Court (tenure). There are no measurements of performance and they can’t be terminated. Congress uses seniority (tenure) as the basis for power and committee appointments. Thank God they can be terminated as we witnessed last November.

 With Obama’s passion for European style Socialism, visualize the potential of “Unionizing” the Executive branch of government. The President and his army of czars could go on strike for better pay and fringe benefits. Who could stop them? What would happen if the Supreme Court decided to strike? If Congress went on strike and refused to function, who could stop them? I could drive you insane with the possibilities of what an uncontrolled government could do. If you wish to see what idiots who mesmerize the populace can do, read what Chavez has done in Venezuela. See how he used the unions to get elected and gain dictatorial powers. Why can’t this happen here? 

Before you accuse me of insanity, look at what is happening in the real world today. All democratic State Senators in Wisconsin left the State to avoid doing state business. The Governor has not been able to get them to return. The media legal eagles have stated that there is no law being broken and no one has the power to arrest them for anything.  

I would like to say that if a quorum of Congress were to do the same thing, it would be tragic. Unfortunately it could probably be an improvement over the idiotic regulations and Obamacare they raced to impose before the last election. Congress has allowed the Executive branch to run wild for over two years. If the Environmental Protection Agency (EPA) alone is not abolished soon, we just think energy prices are high today. Locally the price for gasoline has jumped about 9% in the last week. Coupled with out of control spending, we are watching America destroyed from within. Our current government in action at all levels is like watching cartoons. 

I am now compiling data and facts of what “Unionization” of the teachers in Wisconsin has cost the citizens. The questionable legality of how they are provided insurance alone will amaze you. The teachers own the insurance company and collective bargaining is how they have screwed the taxpayer. Stay tuned for a series on public service unions nation-wide.

HEALTHCARE TRAIN WRECK-MEDICAID

Let me share some information concerning out of control healthcare costs. Every American should understand that “Medicaid” is the most abused program ever created by our Congressional idiots. The current issue concerning proof of citizenship being debated in Arizona is a smoke screen for Washington to hide behind as a rights issue. Ignoring the real causes of the skyrocketing costs of healthcare makes my blood boil. I listen to the doctors say verifying citizenship before service in an emergency room(ER) is wrong. They get well paid for providing ER service and likely do not accept Medicaid in their own private practice. It is now hard to find any doctor in the large cities that accept Medicaid or Medicare. This forces indigent people to go to the ER’s for routine healthcare. All business training insists that service without compensation is the fastest path to bankruptcy. The use of emergency rooms for non-critical doctor visits is destroying our healthcare system.

In addition to the government forcing people to go to the ER for routine service another fraud is happening. This involves the people who misuse our emergency rooms to avoid having to pay a doctor for a routine office call. Our Washington welfare mentality actually encourages some to use the ER rather than visiting a doctor in their office. I am “NOT” suggesting we deny anyone the right to go to an emergency room for critical help.

I have only been in two emergency rooms in my 80 years. One was when my wife fell in the early evening after our doctor’s office was closed. Her fall required stitches and our local hospital did a great job in sewing her up. My only personal visit was June 10, 2010 when I awoke at 4am with severe intestinal pain in my right lower abdomen that was self diagnosed as appendicitis. Again the local hospital, after extensive tests proved my diagnosis was in error and I had suffered a case of diverticulitis. So far this has reoccurred twice since with a trip to the doctor rather than another $4,000+ trip to the ER.

The point I desire to make is that on both occasions the desire to discover whether we were paying customers and with proper identification was equally as swift as the treatment we received. Did this upset me, no it is just common sense business practice that I have encountered with my trips to any medical facility over my entire lifetime. This is true at a doctor’s, dentist’s, specialist office, hospital or any other health care provider. They have the right to know how they are to be paid.

With the knowledge that they will not be served without proof of payment, every freeloader in America disrupts normal emergency services with routine, non emergency, trips to the ER’s of America. Folks this is not rocket science and it happens 24/7 across this nation that is broke.

I recently visited with someone in one of America’s largest cities that works in an emergency room. I am certain what I am going to describe are actual facts that happen thousands of time every day. “A well dressed woman brought in a child for ER treatment. She had a designer handbag, cell phone and expensive accessories in plain view. When the doctor told her that the child had a cold and needed to be given over the counter medication, she went ballistic demanding that the doctor provide a prescription. Her reasoning shared with the doctor was that without a written prescription she could not get the medication free as she had no insurance”.

Now let us look at this example of this event. Should the doctor refuse the demand what will happen? His next contact would be with a probable law suit for the refusal to provide ER service. I have five doctors in my immediate family and know what malpractice insurance costs. Lawyers have forced the medical industry to waste trillions and are the primary reason we face run-away costs for healthcare. To be fair, I also have two lawyers and another half way through law school in my family. Thank God they do not prey on healthcare to make a living.

I challenge everyone that reads this posting to go to the local emergency room for a couple of hours and just observe and ask questions. If this does not convince you that the Congress must address fixing Medicaid, passing tort reform and controlling the illegal’s, you are an idiot like the ones who designed Medicaid.

Nothing will happen until enough people who have to pay for this debacle rise up and scream at the top of their lungs. I encourage you to send a copy of this post to your Congressman and your State Representative/Senator to prove me wrong with facts. I will do this also. If just one Representative or Senator will look into this situation and force the media to get involved, something might happen.

If Congress or the States ignore this waste, we the people, have the ultimate power to use the ballot box again to demand common sense.

COMMON SENSE HOME OWNERSHIP

 

Let me share some interesting facts that I was not aware of probably because the news media in the USA is wired to promote bad news rather than help find the reasons we have serious problems. I found an article written by Lita Epstein a real estate publication that should interest everyone who is concerned about the billions of dollars likely wasted in the US real estate fraud. Congress calls it a crisis caused by financial companies when in fact they caused the waste and still hide behind their shield of “Royalty” status and point in every direction but themselves. This is just another reason that term limits are the only solution to provide sanity in Washington. When will we stop this facade? CB

Canada’s homeowners are less likely to face foreclosure? Fewer than 1 percent of Canadian mortgagess are in arrears, compared to the 2.9 million homeowners that received foreclosure notices in the U.S. in 2010.

Your first reaction is to say there are a lot fewer Canadians, and you’re right. Canada’s population is just 34.3 million, while the U.S. population now exceeds 307 million. But foreclosure rates are as high as 20 percent in the hardest hit states, so population alone does not explain the difference.

“Canada avoided the housing bubble that the U.S. has endured. Why, common sense banking practices in Canada. Canada has stricter underwriting standards, and the banks must set aside more money toward potential losses if the market takes a downward turn. Also, Canada has no secondary market for mortgages, like Fannie Mae and Freddie Mac, which means banks can’t sell off their risky mortgages, so they don’t make them in the first place”.

The banks more conservative regarding lending, but private mortgage insurers have more control over mortgage approval. A Canadian who puts less than 20 percent down on the house must pay the full cost of mortgage insurance upfront; and the mortgage insurance company has the authority to approve or reject the property appraisal. This gives banks and buyers a strong incentive to get realistic property appraisals.

“When people apply for a mortgage in Canada, there are some significant differences to the type of mortgage they’ll get. Most Canadian mortgages are for 25 years, and the interest rate readjusts to the current interest rate every five years. This encourages Canadians to pay off their mortgage faster. There are also substantial prepayment penalties that discourage refinancing, especially to tap equity”.

Canadians don’t get a tax deduction for mortgage interest, so they don’t have an incentive to keep paying on a mortgage. The U.S. tax incentive for mortgages may soon be reduced as part of the deficit reduction efforts to be considered in this Congress.

“If you have a mortgage in Canada, you can’t just walk away. Canada has full recourse on mortgages, which means you must pay off the mortgage even if the bank forecloses on your home. If the bank forecloses and the house is worth less than the mortgage, the bank can sue for a deficiency judgment. The bank can then attach a lien to other assets and garnish future wages. Some states in the U.S. are full-recourse states, but others, such as California, are not”.

Canada does not encourage homeownership for low-income households. Instead the Canadian government provides public funding for low-income rental housing. There is no subprime lending in Canada. Sounds like common sense!

Prior our government relaxing the rules, created Fannie Mae and Freddie Mac that led to the the boom years, banks required information to prove income and held to strict income standards. Banks also held appraisers to higher scrutiny. That’s what Canadian banks continued to do, while the U.S. lowered their underwriting standards.

 THE GYNECOLOGIST WHO BECAME A MECHANIC
 A gynecologist had become fed up with malpractice insurance and HMO paperwork, and was burned out. Hoping to try another career where skillful hands would be beneficial, he decided to become a  mechanic. He went to the local technical college, signed up for evening classes, attended diligently, and learned all he could. 
 
 When the time of the practical exam approached, the gynecologist prepared carefully for weeks, and completed
 the exam with tremendous skill. When the results came back, he was surprised to find that he had obtained a score     of 150%. Fearing an error, he called the Instructor, saying, “I don’t want to appear ungrateful for such an outstanding result, but I wonder if there is an error in the grade?” 
 
“The instructor said, “During the exam, you took the engine apart perfectly, which was worth 50% of the total mark. You put the engine back together again perfectly, which is also worth 50% of the mark.” After a pause, the instructor added, “I gave you an extra 50% because you did it all through the muffler, which I’ve never seen done in my entire career”.
