AFFORDABLE ATTORNEY ACT!

The recent article I posted, “THE AFFORDABLE BOAT ACT”, resulted in over 1000 people who I hope realized how ridiculous Congress and Obama’s vision is for America’s future. Obama and his band of Progressive-Liberal Democrats, have created more need for an “Affordable Gun Act” as their scare tactics have armed Americans for a war with each other. The increased price of guns and ammunition has far our paced healthcare. Can you imagine a government subsidy for poor people and illegal aliens to buy guns and ammo to steal more wealth from the people who create jobs and saved for their retirement?

The “ObamaScare Act” was just another illusion designed to nationalize and control this huge portion of our economy. This has been another step in nationalizing anything the Progressives desire. They are not in a hurry as we watch them intensify the destruction of the finance industry. Makes you wonder what comes next after they allow 13 million aliens to become American citizens.

Do you honestly believe that we would have the current healthcare debacle if Doctors, instead of Lawyers and bureaucrats, were allowed to improve our healthcare system? Lawyers can’t even agree on what the current law actually implies or how it is applied and controlled. We have nine Supreme Court Justices, all law school graduates, who can’t even read our Constitution the same way. Lawyers and members of Congress are required by law to be honest and ethical but look who evaluates their performance? Lawyers and members of Congress, not business men, Doctors, plumbers or even the jury system unless they kill someone.

Lawyers and members of congress should be required to buy malpractice insurance as they destroy the lives of more Americans that all of the doctors in the world. Listening and reading about the reduced coverage for seniors and the unrealistic cost increases for working Americans to have insurance coverage is unbelievable. ObamaScare was enacted 100% by the Progressive-Liberal Democrats to wreck the healthcare insurance industry and to eventually enact “HillaryCare” they tried to force on Americans 20 years ago. These demented leaders will never be satisfied until the government can finally eliminate all “States Rights” and control every aspect of our lives from Washington D.C.

Hang on to your seatbelt and prepare yourself for 100% government control of every aspect of healthcare from cradle to grave. You will receive whatever coverage some bureaucrat decides is best for the government. All doctors will be paid the same amount for every procedure from a snotty nose to organ transplants. The incentive for young people to become a doctor will be nothing as they will continue to be paid less than a plumber as they are today.

I was advised last week that reimbursement for my annual PSA test will no longer be paid for by Medicare. It appears that most preventive tests for people over 75 will be part of the cuts in our coverage. I am 83, blessed in rather good health, and my mother lived to 94. Prostate cancer is inevitable for every man if he lives long enough. The local fee for the PSA test is $156.00. Can you imagine how much it will cost if I get cancer. I suppose the bureaucrats pray it will be fatal rather than lingering as it certainly will not be cheaper if I receive medical treatment. Would my doctor or accountant agree? No.

I still correspond with a doctor that saved my life a few years ago, long before Obamacare. He shared with me some of the unnecessary and expensive paper work required to treat seniors like me under Medicare. About five years ago he closed his practice and became a “Hospitalist Doctor” in another State. He was sick of the paperwork, reporting requirements, waiting months to be paid for his work and spending more time with paperwork than “doctoring” actual people. He sent me a message one day telling me he experienced a stopped up toilet and it costs $150 an hour to get a plumber to fix it. A few days later his computer went berserk and he had to pay the “Geek Squad” $125 an hour to find and eliminate the little gremlins running wild inside the box. The point he made was that he was paid $96 an hour to save people’s lives which seemed an inequity. He finally gave up Doctoring and is now working in the financial industry that is more rewarding as the Lawyers don’t know how to totally screw them up, yet. They are trying and Congress has enacted some laws to attempt to control them closer. The only losers are those of us who depend on savings to enjoy retirement. They will eventually enact enough new laws to destroy the free enterprise system which is also a Progressive-Liberal long-term goal.

I gathered some very interesting statistics I wish to share. We currently have 100 Senators and 60 of them are Lawyers. We have 435 members in the House of Representatives, 162 of them are Lawyers. That computes to the fact that 43% of Congress members are Lawyers. To let you see the balance we have 33 doctors in Congress.

Those statistics did not surprise me but when I dug a little deeper I now understand why we are in deep dodo. These figures coupled with common sense certainly justify the need to enact the “Affordable Attorney Act” (AAA), and fast. The latest numbers I could find were for 2008, this was no surprise. In 2008 we had 303,824,640 people in the United States. We had 1,128,729 Lawyers and 661,400 Doctors and that blew my socks off. We have two Lawyers for every Doctor.

The last time I needed legal help I was quoted a fee of $400 an hour. The last hour I spent with my Doctor, Medicare was billed for $110 probably paid $60. The Doctor helped me and the Lawyer fee made me sick. Poor people are screwed if they need legal help but Congress is hell-bent on punishing Doctors by reducing and controlling what they can be paid.

Congress has totally screwed up healthcare. It is now time for the “AAA” but never fear it will never happen. We should nationalize all of the nation’s law schools and standardize exactly what a Lawyer can do and how much he can charge. Why not cap the payments for Lawyers like we do for Doctors. Allow them to charge $500 for a divorce, $200 for a will, $2,000 to defend a murderer and no more for an hour of their time than a Doctor can charge. The only ones who will scream about this are Lawyers and the Lawyers in Congress who can’t make a living chasing ambulances and become career politicians. Progressive-Liberal Democrats have about as much common sense as a drunk monkey. Unfortunately if they nominated a drunk monkey for our next President, too many women, most young folks, all welfare receivers, all aliens and enough dead people will elect “It”. I used the term “it” on purpose as it appears our next President will be Hillary.

Demand that we allow Doctors to control the best healthcare system in the world before the Lawyers completely destroy it. Let the insurance companies cross State lines, eliminate frivolous law suits and force all Lawyers to face the same malpractice exposure when they take a case and lose it.

EDUCATION TEXAS-SHOULD TESTING BE MORE IMPORTANT THAN TEACHING?

 

 

The good news for teachers is that the ill-fated Texas Assessment of Knowledge and Skills (TAKS) testing will be given a well deserved funeral in 2011. This was an unfunded mandate that never deserved a breath and actually replaced valuable teacher time. Teachers were forced to teach for the test rather than teach to have students gain knowledge.

The bad news is our illustrious Legislature mandated 12 end-of–course assessments for high school students in Senate Bill 1031 in 2007 and created new graduation requirements for an additional year of math and science plus grade 3-8 assessments in House Bill 3 in 2009. This resulted in a new State of Texas Assessment of Academic Readiness or STAAR test to replace TAKS. Wow!

So STAAR grades 3-8 test will include:

Grade 3 Reading and Math

Grade 4 Reading, Math and Writing

Grade 5 Reading, Math and Science

Grade 6 Reading and Math

Grade 7 Reading, Math and Writing

Grade 8 Reading, Math, Science and Social Studies.

STAAR High School tests will include:

English I, English II, English III, Algebra I, Geometry, Algebra II, Biology, Chemistry, Physics, World Geography, World History, and United States History. 

In plain language the new tests will be used beginning in the 2011-2012 school year. Students entering ninth grade next year will be the first who must meet the extra course in math and science and be subjected to the end-of-course testing requirements. By the way they must also pass their classes, in order to earn a diploma.

Another tidbit you have to search for is what does all of this STAAR surprise cost? A concerned citizen, using the open record law found the answer. The STAAR testing program has been awarded to a for-profit company in the amount of $468,382,617.00 that will cover the period from 2010-2015.

By the way, there has been no additional training developed for the K-12 administrators or teachers and they face not having textbooks or any preparatory classes to prepare students for the additional science/math requirements. Like the TAKS program teachers will be forced to teach to the STAAR requirements. Any failure of students to pass the tests will be blamed on the teachers like happened when TAKS produced negative results.

If our Superintendents and teachers were allowed to demand discipline there would be no need for a testing program. It is criminal that teachers must have liability insurance to protect their personal property. No wonder we have a broken system. It should be no surprise that our Texas education system in our prisons is highly successful, why? There is no discipline problem with prisoners. Why can’t educators accept that until teachers and administrators are allowed to demand discipline, wasting money with testing is irresponsible! They do not care.

Texas current academic performance measured with all states has diminished over the past few years and we are planning to slash the state funding as much as 20%. It appears that someone in Austin is back to smoking weeds. Only dreamers like the State Board of Education and the legislature can develop these pie-in-the-sky grandiose programs. They believe that they can cut spending and snap their fingers and all Texas students will be ready for the universities and we will have thousands of Academics and Rocket Scientists, available to find unemployment?

When will someone in America wake up and admit that every child will not attend a college or university. We spend billions year after year preparing all children to go to a place of higher learning, knowing full well most will never go.

America is the only industrialized nation on the planet that has little or no trades education for those who will eventually be policemen, firefighters, plumbers, carpenters, cosmetologists, small business owners, etc. Maybe if we could have courses to prepare some students for a political future, we could reduce the costs of our Congress and Legislatures. Most politicians are lawyers and they could be free to return to doing the legal work they were educated to perform. The way they have screwed up America, I suspect some would have to be re-educated on how to chase ambulances again!

For those who read my article on education in the Texas prisons, providing free trades education in high school might help the ones who are lost or drop out of school. Knowledge that would help them find jobs might keep some from joining gangs, selling drugs or other criminal activity. They would fit into society at graduation. Now, if they desire to learn a trade after high school, it is not free and the ones who can’t afford higher education certainly can’t afford the trade school fees.

The only way to get a free education today without grants is to go to prison. It would be nice if the U.S. Department of Education could provide PELL grants for a trade’s education initiative. They spend billions annually to send the under-privileged and the ill-prepared to a college or university with little or no hope that the majority will graduate. They try to make the shoe fit even if it is impossible and accomplish a ten percent result. If we would evaluate every child after the eighth grade and have two courses of opportunity, trades versus academics, we would have the right shoe on the right foot.

What I have outlined is nothing more than common sense. Sadly the academics and politicians that design and fund education were never subjected to a course in common sense and most have never had to make a payroll every week. The really sad part is they really do not care about our children as they just want power and prestige.
